Introduction

Welcome to Azure Travel LLC (“Azure”). By using our website, booking a villa, or listing a property with us, you agree to the following Terms & Conditions.


Definitions

  • “Company,” “we,” “us”: Azure Travel LLC or Azure.
  • “Guest(s)”: individuals booking or staying at a property.
  • “Owner(s)”: individuals or entities listing their property.
  • “Party(ies)”: any one or a multiple or all of Company, Guest(s), and Owner(s).
  • “Onsite Management”: property staff or managers provided by the Owner.
  • “Services”: villa marketing, bookings, and guest intake facilitation.

Our Role

Azure acts as a booking intermediary, not the property operator. Owners are responsible for property conditions, safety, and onsite services. Azure does not provide, furnish, contract for, arrange, or advertise that Azure arranges or has arranged, wholesale or retail air or sea transportation either separately or in conjunction with other travel services or land or water vessel transportation either separately or in conjunction with other travel services.


Booking Terms (Guests)

  • Reservations confirmed only upon payment.
  • Guests must comply with Owner rules and property policies.
  • Damages caused by Guests are chargeable to the Guest.

Owner Terms

  • Properties must have onsite management.
  • Owners are responsible for accuracy, legality, and safety.
  • Azure facilitates bookings and guest intake, charging agreed fees.
  • Azure will take its fees from the nightly rate before sending the remainder to Owner.

Property Rules

  • Each villa has Owner-set rules.
  • Guests will be provided these rules before or at check-in.
  • Compliance is mandatory.

Guest Responsibilities

  • Respect occupancy limits, property staff, neighbors, and local laws.
  • No disruptive parties or illegal activity.
  • Care for property contents.
  • Guests are required to pay according to the terms of each Property, including any cancellation policy.

Payments & Refunds

  • Payment terms disclosed at booking.
  • Refunds subject to the property’s cancellation policy.

Damages & Deposits

  • Guests are liable for damages or loss.
  • Security deposits may be withheld or additional charges applied.

Check-In / Check-Out

Times set by the Owner. Early/late requests are at Owner’s discretion.


Cancellations & Refunds

  • Subject to the property’s cancellation policy. Azure Travel does not guarantee refunds beyond those terms.
  • Owners must honor confirmed bookings unless unavoidable.

Liability

  • Azure’s liability is limited to USD $10,000 in aggregate per claim or incident.
  • Not liable for property safety, guest behavior, or force majeure.
  • Insurance remains the responsibility of Guests and Owners.
  • Azure Travel is not responsible for property conditions or onsite services.
  • Guests are encouraged to obtain travel insurance.

Governing Law

This Agreement is governed by the laws of California, USA.


Alternative Dispute Resolution

Any and all disputes must first be attempted to be resolved between the Parties. Should the Parties not resolve the dispute, the parties must conduct responsibly and reasonably attempt to mediate any dispute at JAMS Mediation, Arbitration, and ADR Services in San Franciso according to JAMS rules. All costs for mediation are to be divided equally between the parties. Should mediation not resolve any dispute, the parties will go to binding arbitration at JAMS Mediation, Arbitration, and ADR Services in San Franciso according to JAMS rules. Mediation and arbitration can be attended by zoom or other video conference service provided for by at JAMS Mediation, Arbitration, and ADR Services in San Franciso. ALL PARTIES AGREE TO WAIVE THEIR RIGHT TO A JURY TRIAL.
